阻卻違法

阻卻違法（affirmative defense、積極抗辯、確認的抗辯、肯定性答辯）在民事訴訟或刑事的指控，是除了原告人或檢察官所指稱的事實外；如果還有一組事實，經過被告證明，結果原告人或檢察官的告訴失敗、或者減輕了被告的非法行為之法律罪責的抗辯謂之。在民事訴訟中，阻卻違法包括：詐欺防止法、棄權，及其它的阻卻違法事項；諸如美國联邦民事诉讼程序第8(c)條所列的消滅時效。 在刑事訴訟法中，阻卻違法的例子則是正当防卫，[1]精神障碍辩护，以及消滅時效等。

法理敘述

在阻卻違法中，被告可以承認他們犯有所指稱的行為，但證明行為是否事實要根據法律的規定，要么並無犯案或者豁免這些不法的行為、或者駁回原告的指稱。 在刑法中，阻卻違法有時被稱為辯護理由、或者豁免辯護。[2] 因此，阻卻違法限制、或者豁免被告的刑事有罪、或者民事責任。[3]

阻卻違法可以明白的說是正当防卫。[1]簡而言之，如果一位刑事被告可以證明她是實在及合理的相信另一人（原告）使用暴力是非法的；而且被告的行為是為保護自己的必要條件，則可以免除刑事上的被告訴。[4]
